By using this site, submitting work, or buying an edition, you agree to a few common-sense rules: be respectful, only submit work you own the rights to, and remember that each edition is a one-time purchase (no recurring billing). 1. Accepting these Terms

These Terms of Service ("Terms") are a contract between you and the Strawberry Moon Tribune ("Tribune," "we," "our"). By visiting https://www.strawberrymoontribune.com, submitting work, signing up for the Street Team, buying an edition, or otherwise using the site, you agree to these Terms. If you do not agree, please do not use the site.

2. About the Tribune

The Tribune is an independent arts publication that releases a new edition each new moon. We accept open submissions from creators, publish a digital and physical magazine, host a community Street Team, and sell individual editions of the magazine as a one-time purchase. The features available, the publication schedule, and pricing may change over time.

When you submit creative work through https://www.strawberrymoontribune.com/upload (a "Submission"), you confirm and agree that:

This license is perpetual for any edition that has been published. Once an issue has run, we can keep it in the archive and continue distributing it as part of that issue. For unpublished Submissions, you can request removal at any time by emailing info@strawberrymoontribune.com.

Credit

We will credit you using the preferred name you provide on the submission form, plus your Instagram handle and website if you supply them. If you don’t want to be credited by a particular handle, just tell us.

No obligation, no compensation

We are not obligated to publish any Submission, and we do not pay for Submissions unless we have a separate written agreement with you that says otherwise.

5. Editorial discretion

We pick what goes into each edition based on our editorial judgment. We may accept, reject, hold, or remove any Submission at our discretion. Acceptance for one edition does not commit us to publishing more of your work. If your Submission is selected, we will email you confirmation through our email service provider before publication.

9. Tribune intellectual property

The Strawberry Moon Tribune name, logo, masthead, layout, design, original editorial content, software, and code are owned by the Tribune (or its licensors) and are protected by copyright, trademark, and other laws. You may share links to public pages and quote brief excerpts of editorial content with attribution. Any other use requires our written permission.

10. Third-party services

The Tribune relies on a small set of third-party providers to run the site. By using the site you understand that data may flow through these providers consistent with their own terms and privacy policies:

11. Termination

You can stop using the site or unsubscribe from the Street Team at any time. We may suspend or terminate your access if you breach these Terms, attempt to harm the Tribune or its community, or if we are required to do so by law. Sections that by their nature should survive termination (Submissions license, intellectual property, disclaimers, liability, indemnification, governing law) survive. Access to any edition you have already purchased survives termination of your Street Team membership.

12. Disclaimers

The site and all content are provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the site will be uninterrupted, error-free, or completely secure. Opinions expressed by contributors are their own and do not necessarily reflect the views of the Tribune.

13. Limitation of liability

To the maximum extent permitted by law, the Tribune and its founders, officers, contractors, and licensors are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the site, even if advised of the possibility of those damages. The Tribune’s total aggregate liability for any claim arising out of or relating to these Terms or the site will not exceed the greater of (a) US $100 or (b) the total amount you paid the Tribune in the 12 months before the event giving rise to the claim.

14. Indemnification

You agree to indemnify, defend, and hold harmless the Tribune and its founders, officers, contractors, and licensors from any claim, loss, liability, or expense (including reasonable attorneys’ fees) arising out of (a) your Submissions, (b) your use of the site, (c) your breach of these Terms, or (d) your violation of any third party’s rights.

15. Governing law and disputes

These Terms are governed by the laws of the State of South Carolina, USA, without regard to its conflict of laws rules. Any dispute arising from or related to these Terms or the site will be brought exclusively in the state or federal courts located in South Carolina, and you consent to the personal jurisdiction of those courts. Nothing in this section prevents either party from seeking equitable relief (such as an injunction) in any court of competent jurisdiction. If you operate the Tribune from a different state in the future, update this section.

16. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top. If the changes are material (for example, a change to the Submissions license or purchase terms), we will make reasonable efforts to notify Street Team members and recent buyers by email. Continued use of the site after the effective date of an update means you accept the updated Terms.
